Trade Promotion Terms and conditions

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is only open to Australian residents 18 years and over in Queensland, New South Wales, ACT and Victoria. (“Eligible Entrant”).

  3. Employees (and their immediate families) of the Promoter, participating distributors and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  4. Promotion commences on 18th of July 2022 at 09:00AEST and closes 12:00AEST on 15th October 2022 (“Promotional Period”).

  5. To receive an automatic entry into the draw, an Eligible Entrant must register and have a Membership to Taverner Motorsports during the promotional period. For every Bronze Membership you will receive 1 entry, for the Bronze Plus Membership you will receive 1 entry for every month of active membership until the giveaway, for the Silver Membership you will receive 3 entries, for the Silver Plus Membership you will receive 4 entries for every month of active membership until the giveaway, for the Gold Membership you will receive 10 entries, for the Gold Plus Membership you will receive 10 entries for every month of active membership until the giveaway.

  6. The draw will take place at Joe’s Diner, 1084 Kingsford Smith Drive, Eagle Farm on the 15th of October 2022 at 19:00 AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by email and phone within two (2) business days of the draw, and the name of the winner will be published online at www.tavernerpromotions.com as well as the Promoters Facebook and Instagram accounts from 20:00 17th October, 2022. The winner will be drawn using TPAL Electronic Draw System which is a government certified and compliant random draw system.

  7. The Promoter’s decision is final and no correspondence will be entered into.

  8. There is 1 prize to be won. The first valid entry drawn from all entries will win a 2021 (MY22) Harley Davidson Sportster S and on road costs (including 12 months registration & CTP insurance, applicable stamp duty, plate fee but excluding any additional insurances). Valued at $29,000. In the event the winner hasn’t claimed the prize by 09:00AEST 12th of November 2022 the second valid entry drawn will be notified and be entitled to claim the prize. In this event the winner will be notified by phone and email within two (2) business days, and the name of the new winner will be published online at www.tavernerpromotions.com.

  9. Prize is not transferable or exchangeable.

  10. A draw for an unclaimed prize may take place on subject to any directions from a regulatory authority or if the winner hasn’t claimed the prize by 09:00AEST 12th of November 2022. In this event the winner, if any, will be notified by phone and email within two (2) business days of the draw, and the names of the winner will be published online at www.tavernerpromotions.com.

    11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  11. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  12. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
    reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by any Eligible Entrant; or (f) taking of a prize.

  13. Facebook membership, Facebook pages, Facebook applications and use of Facebook generally is subject to the Facebook prevailing terms and conditions of use available at http://www.facebook.com/policies. The competition is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their Entries and any other information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and their associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the competition. Any questions, comments or complaints about the competition must be directed to the Promoter and not to Facebook. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram and entrants agree to the complete release of Instagram.

  14. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. All entries become the property of the Promoter.

    16. The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy. The Privacy Policy also contains information about how individuals may opt out, access, update or correct their PI. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia. The products and services are provided, and ‘our’ websites are provided, by Taverner Motorsports (ABN 69 469 183 644) (‘we’, ‘us’ or ‘our’). ‘We’ are committed to supporting the ‘Australian Privacy Principles’ and complying with the Privacy Act 1988 (Cth), which has set clear standards and guidelines for the collection, access, storage and use of Personal Information (‘Personal Information’) which ‘we’ may obtain during the course of ‘our’ dealings with you. ‘Our’ Privacy Policy sets out, in general terms, matters of which you should be aware regarding the Personal Information ‘we’ may collect about you, ‘our’ policies on the management of personal information, how you may access Personal Information that ‘we’ keep or complain about a suspected privacy breach, and generally, what sort of information ‘we’ collect and how ‘we’ hold, use and disclose that information. When you provide ‘us’ with Personal Information (whether via one of ‘our’ websites, through any of ‘our’ promotions, or otherwise), ‘we’ respect your privacy.

The type of Personal Information that we collect and use depends on the type of dealings that you have with us and can include your name, address, telephone number, e-mail address, postal or delivery address, date of birth, billing information (such as credit card and bank account details), proof of identity information and documents, information about the products and services you have ordered or enquired about and your beauty profile. If you would prefer that we do not collect any Personal Information from you, please do not provide us with any such information.

When you submit your Personal Information to us, or by using, browsing or accessing our websites or social media channels, you are giving your consent to the collection, use and disclosure of your Personal Information as set forth in this Privacy Policy.

Where we have collected Personal Information about you from another source, we will take reasonable steps to ensure that you are made aware of the following:

We will collect Personal Information about you in a variety of ways, including:

  1. through your use, or orders of, of our products and services; when you visit or submit information through our website, social media or and other online channels, when you contact us with a query or request information about our products and services, complete any forms or agreements for our products and services, when you participate in competitions, promotions, events, sweepstakes, surveys, questionnaires or rewards programs
  2. from third parties (including our related bodies corporate, business partners and service providers, credit reporting bodies and government agencies)
  3. and from publicly available sources of information (including, but not limited to, social media sites).

The Personal Information collected by us will track your use, or enhance your use, of the foregoing and assist us in providing a better service. We do not use or share Personal Information for any purpose other than for the purpose for which it was disclosed. By providing your Personal Information to us, you acknowledge that you are authorised to provide such information to us. We may collect Personal Information about you for our related bodies corporate and service providers and when you request information about products and services. We will only collect Personal Information that is necessary for one or more of our functions or for the purpose disclosed to you.

  1. HOW YOUR PERSONAL INFORMATION IS USED

We use your Personal Information for the purposes for which the information is collected. The Personal Information that we collect is generally used to provide our products, services, customer rewards programs, website and social media channels (including customised online content and advertising displayed on our website or social media channels) to you. We also use it to improve or develop our products, services and website, to operate, maintain and test and upgrade our systems and to notify you of opportunities that we think you might be interested in. We do not use or share Personal Information for any purpose other than for the purpose for which it was collected and disclosed. We do not provide, trade or sell Personal Information to other organizations without your consent. However we may disclose Personal Information to our related bodies corporate, business partners, third party contractors, agents and suppliers and service providers (as set out in section 7b. below) in connection with providing our product or service to you.

If you provide your Personal Information to us, whether via one of our websites or social medial channels, through any of our promotions or competition, or otherwise, the information you provide may be used by us to include you in a customer rewards program, create and deliver to you direct mail, emails, sms, surveys or attend customer research or discussion groups or other communications containing product, services and event information, tips, promotions or competitions. If you prefer not to receive such communications including those of any rewards programs- see Section 5. below.

  1. KEEPING INFORMATION ACCURATE AND UP TO DATE

We take all reasonable steps to ensure that all Personal Information we hold is accurate however it is your responsibility to ensure that the information you provide us is accurate and that you advise us of any changes to your details. You may contact us at any time and ask for its correction if you feel that the Personal Information we have about you is inaccurate or incomplete.

If we determine that Personal Information is no longer needed for any purpose, we will take reasonable steps to destroy or permanently de-identify that Personal Information, unless we are required by law or a court or tribunal to retain the information.

  1. DIRECT MARKETING

Where we have your express or implied consent, or where we are otherwise permitted by law, we may use your Personal Information to send you information about the products and services we offer, as well as other information that may be of interest to you. We may send this information by mail, email, SMS telephone, on or via social media or other online channels (including by customising online content advertised or displayed on our websites or social media channels) If you do not wish to receive direct marketing communications from us, you may opt-out at any time by: (a) using the unsubscribe facility that we include in our commercial electronic messages; (b) Contacting us at enquiries@tavernermotorsports.com.au. This may not remove you from any customer rewards programs or remove you from receiving any social media or other online channels communications or customised online content advertised or displayed on our website or social media channels.

  1. KEEPING INFORMATION SECURE

We take reasonable steps to ensure your Personal Information is protected from unauthorised access, loss, misuse, disclosure or alteration, both online and offline. We store Personal Information in different ways, including in paper and electronic form. We use security procedures to protect the Personal Information we hold. Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure, however we will endeavour to take all reasonable steps to protect the personal information you may transmit to us.

Access to and use of Personal Information within our organization is limited by us to prevent misuse or unlawful disclosure of that Personal Information by others. Our employees, contractors and service providers are obliged to respect the confidentiality of any Personal Information held by us.
